These Terms of Service are the regulations for electronic services provided through Crosspad. Please read them before creating an account or using the Service.

1. Acceptance and Scope of Terms

These Terms apply to the Crosspad website, the Crosspad native mobile applications for Android and iOS, and connected services (together, the "Service"). You accept these Terms when you expressly agree to them during account registration or when another Service flow clearly asks you to accept them. You must be able to access, save, and reproduce these Terms before entering into a contract.

If you use parts of the Service that do not require an account, these Terms govern that use to the extent applicable. If you do not agree to these Terms, do not create an account or use the Service.

Our Privacy Policy, Cookie Policy, and Account Rules & Community Guidelines form part of the rules governing the Service.

2. Description and Conditions of the Service

Crosspad allows users to create, edit, play, download, and share drum kits and audio samples. The Service includes, among other features:

  • Playing and performing with kits in a supported browser or mobile application
  • Creating and managing sound kits
  • Uploading and organizing audio samples
  • Sharing published kits with the Crosspad community
  • Downloading kits for offline playback in the mobile applications

2.1 Technical Requirements

To use the Service, you need a device with internet access, a current supported web browser or a compatible version of the Android or iOS application, and JavaScript enabled for the website. Some features require an email account, sufficient device storage, audio output, or permissions described in the Privacy Policy. You are responsible for your internet connection and device costs.

We may publish minimum operating-system, browser, file-format, and file-size requirements in the relevant interface. Using outdated software may limit functionality or security.

2.2 Contract Formation and Duration

A contract for account services is concluded when you complete registration, expressly accept these Terms, and we confirm or activate your account. The free account service continues until you or we terminate it in accordance with these Terms.

Guest features are supplied when you request and receive the relevant feature. You may stop using guest features at any time. You may terminate your account contract at any time through the available account-deletion process or by contacting us.

2.3 Future Paid Features

The Service is currently provided free of charge. We reserve the right to introduce paid features, subscriptions, or a paid plan in the future. Any such introduction will be communicated in advance, together with the applicable price, billing period, main features, contract duration, renewal and cancellation conditions, payment method, and any other pre-contract information required by law. Statutory consumer rights, including the EU right of withdrawal where it applies, will not be limited by these Terms.

2.4 Conformity and Updates for Consumers

Where consumer law applies, we are responsible for supplying digital content and digital services in conformity with the contract and for providing updates, including security updates, required to maintain conformity. If a digital service is not supplied or does not conform, the consumer may have statutory rights to require supply or conformity, receive a proportionate price reduction, or terminate the contract. Nothing in these Terms limits those rights.

3. Account Registration

To use certain features, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password and authentication methods secure and confidential
  • Accept responsibility for activity under your account to the extent permitted by law
  • Notify us promptly of suspected unauthorized access

You must be at least 16 years old to create an account. If you are under 18, you confirm that you have any parent or guardian authorization required under the law applicable to you.

4. User Content

4.1 Ownership and License

You retain ownership of audio samples, kits, and other content you upload or create ("User Content"). You confirm that you have the rights necessary to upload and use it.

You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, process, adapt to technical formats, display, and transmit User Content only as necessary to operate, secure, and improve the Service and to make content available according to the visibility settings you select. The license for non-public content ends when that content is deleted, subject to temporary technical copies and legal retention duties. The license for published content continues until the content is deleted or made private, except for copies that other users lawfully obtained before that change.

4.2 Restrictions

You must not upload, share, or distribute content that:

  • Infringes intellectual-property or other third-party rights
  • Contains copyrighted material you are not authorized to use
  • Is illegal, fraudulent, threatening, abusive, or unlawfully discriminatory
  • Contains malware, viruses, or harmful code
  • Violates applicable law or these Terms

4.3 Content Moderation and Illegal-Content Notices

We may restrict visibility, remove content, suspend access, or take other proportionate action where content is illegal or violates these Terms or the Account Rules. We consider the nature, severity, frequency, context, and consequences of the violation and act with due regard to users' fundamental rights.

Anyone may report suspected illegal content through the reporting tools available in the Service or the Contact Form. A sufficiently precise notice should identify the content, explain why it is considered illegal, provide its exact location or kit identifier, include the reporting person's contact details where legally required, and contain a good-faith statement that the information is accurate.

We process notices in a timely, diligent, objective, and non-arbitrary manner. Where required by the Digital Services Act, we will confirm our decision to the reporter and provide an affected user with a clear statement of reasons, including available appeal or redress options. We may withhold information where disclosure is prohibited by law or would undermine safety, fraud prevention, or an investigation.

5. Acceptable Use

You agree not to:

  • Use the Service for an illegal purpose
  • Attempt to gain unauthorized access to the Service, accounts, or systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated means to scrape or access the Service without permission
  • Impersonate another person or entity
  • Harass, abuse, threaten, or unlawfully discriminate against others
  • Upload files with the intent to disrupt the Service
  • Circumvent rate limits, access controls, or security measures

6. Intellectual Property

The Service and its original content, software, features, branding, and functionality, excluding User Content, are owned by Rezone Group Sp. z o.o. or its licensors and are protected by applicable intellectual-property laws. No rights are granted except those expressly necessary to use the Service under these Terms. Our trademarks and trade dress may not be used without prior written permission.

7. Data Protection

We process account information, User Content, technical data, and other personal data as described in the Privacy Policy. The Service uses Cloudflare infrastructure, and selected features use providers identified in that policy. Mobile applications also store data locally for authentication, preferences, and offline playback.

8. Service Availability and Modifications

We use reasonable efforts to keep the Service secure and available, but temporary interruptions may occur because of maintenance, updates, failures, security incidents, or events outside our reasonable control. Nothing in this section excludes statutory obligations concerning the supply or conformity of digital services.

We may modify the Service for a valid reason, including legal or regulatory requirements, security, technical compatibility, capacity, prevention of abuse, or the addition or improvement of features. We will not charge an additional price solely because of such a modification unless you expressly agree to a new paid offer.

If a modification negatively affects a consumer's access to or use of a continuously supplied digital service beyond a minor extent, we will give clear advance notice on a durable medium where required, explain the modification and its timing, and inform the consumer of any statutory right to terminate without charge.

9. Suspension and Termination

We may suspend or terminate an account for a material or repeated breach of these Terms, illegal activity, a serious security risk, or where required by law. Measures will be proportionate. We will normally provide notice, a statement of reasons, and an opportunity to appeal or remedy the breach. We may act immediately where necessary to prevent harm, comply with law, protect the Service or others, or address serious abuse.

Upon termination, your right to use the affected account features ceases. Provisions that by their nature should survive termination, including intellectual-property, accrued payment, dispute, and lawful retention provisions, remain effective. Statutory consumer rights remain unaffected.

9.1 Account Deletion

Account deletion is available in two forms:

Step 1: Account Anonymization (Automatic after a Grace Period)

When you select Delete in profile settings:

  • Your account enters a 24-day grace period with status "anonymization pending"
  • After that period, the account is anonymized:
    • The public username becomes "User"
    • The avatar is removed
    • Login credentials are deleted
    • Published kits and sounds remain available without being attributed to your former profile
  • You can cancel the pending anonymization during the grace period using the method stated in the confirmation email or by contacting support

Step 2: Complete Deletion (Requires Contact Form)

For complete deletion of the account and associated kits and sounds:

  1. Select Delete in profile settings to receive a verification code by email
  2. Submit an Account Deletion Request with:
    • Inquiry type: "Account Deletion Request"
    • Your account email address and verification code
    • Confirmation of the deletion request
  3. We will process the verified request without undue delay and normally within 30 days

The contact-form workflow is a method of identity verification, not the only way to exercise a statutory data-protection right. You may also send a rights request to k.nowak@rezone-group.com. We may retain specific data where retention is required or permitted by law, for example to establish, exercise, or defend legal claims.

10. Liability

We are liable under mandatory applicable law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for intentional misconduct, personal injury caused by our fault, or mandatory consumer remedies for failure to supply or lack of conformity of digital content or services.

To the extent permitted by law and only for users acting for business purposes, we are not liable for indirect or consequential losses that were not reasonably foreseeable when the contract was concluded.

11. Changes to These Terms

We may amend these Terms for a valid reason, including a change in law, a regulatory requirement, a security need, a material technical change, the introduction or withdrawal of a feature, or clarification of the Terms. A change will be proportionate to its reason and will not retroactively deprive users of acquired rights.

We will provide registered users with clear notice of material changes on a durable medium, normally by email or an account message, within a reasonable period before they take effect. The notice will state the effective date and, where applicable, the right to reject the change by terminating the account before that date. Urgent changes required by law or security may take effect sooner, with notice as soon as reasonably possible.

12. Data Deletion and Retention

12.1 Kit and Sample Deletion

When you delete a kit or audio sample:

  • It may be marked for deletion before permanent removal from active systems
  • Removal from active systems may take up to 30 days
  • Temporary cached or backup copies may remain for a limited period and will not be restored to active use except where needed for disaster recovery
  • Data required by law or for legal claims may be retained only for the applicable period

12.2 Personal-Data Requests

Requests to exercise data-protection rights are handled under the Privacy Policy. We respond without undue delay and in any event within one month, subject to a lawful extension for complex or numerous requests. Identity verification will be limited to information reasonably necessary for the request.

13. Governing Law and Courts

These Terms are governed by Polish law. If you are a consumer, this choice does not deprive you of mandatory protection provided by the law of your country of habitual residence.

Consumers may bring proceedings in any court available under mandatory law, including the courts of their place of domicile where Regulation (EU) No 1215/2012 applies. We may bring proceedings against an EU consumer only in the courts permitted by that Regulation. Nothing in these Terms imposes exclusive jurisdiction where doing so would be unlawful.

14. Complaints and Out-of-Court Dispute Resolution

14.1 Filing a Complaint

You may submit a complaint about the Service, digital-content conformity, or an account decision through the Contact Form by selecting "General Inquiry" and placing "Complaint" in the subject, or by emailing xazu.work@gmail.com.

To help us investigate, include where applicable:

  • Your username and account email
  • A description of the issue and when it occurred
  • Relevant kit, transaction, or message identifiers
  • The resolution you request

Providing the suggested information is not a condition for a valid complaint if we can otherwise identify and assess it.

14.2 Response

We will respond to a consumer complaint on paper or another durable medium within 14 days of receipt unless a different mandatory period applies. Under Polish consumer law, if we do not respond within the applicable 14-day period, the complaint is considered accepted.

A response that does not resolve the dispute will include the reasons for our position and the information concerning consumer alternative dispute resolution required by applicable law.

14.3 Alternative Dispute Resolution

Consumers may seek free assistance from a municipal or county consumer ombudsman (Miejski/Powiatowy Rzecznik Konsumentów) or use an authorized consumer ADR body, including the competent Provincial Inspectorate of Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej), where applicable. Participation in a particular ADR procedure depends on applicable law and our statement after an unresolved complaint.

The former European Commission Online Dispute Resolution platform was discontinued on July 20, 2025. Current information about EU consumer redress and ADR bodies is available through the European Commission's Consumer Redress resources.
